The Office of the Circuit Court Clerk, established under Article 8, Section 9 of the West Virginia Constitution, is a critical component of the state’s judicial system. Circuit Clerks are elected to serve six-year terms, with their duties, responsibilities, and compensation defined by state law.
As an integral officer within the judiciary, the Circuit Clerk holds an independent, elected position, granting them the authority to create policies and procedures necessary to fulfill their legal obligations. While working under the guidance of the Chief Circuit Judge, the Circuit Clerk also collaborates closely with various entities and agencies that form the justice system, ensuring its smooth and efficient operation.

Duties & Responsibilities of the Circuit Clerk
The Circuit Court Clerk serves as the official recordkeeper and fee officer for the circuit court, family court, and mental hygiene office. Their duties, set by statute, include maintaining records for civil, criminal, divorce, custody, guardianship, juvenile, and appeal cases, as well as managing the court’s computerized docketing system.
As fee officer, the clerk collects and disburses fees, fines, and costs associated with cases, ensuring compliance with statutory provisions for payments to the county and state. They also manage bonds, restitution, and witness fees.
In their role as jury administrator, the clerk oversees the selection, summoning, and management of petit and grand juries, providing panels for magistrate and municipal courts.
The clerk offers procedural assistance to pro se litigants, serves as a liaison to the public and media, and compiles monthly statistical reports for the West Virginia Supreme Court of Appeals.
